Roger Clemens; the 50th Anniversary of the Daytona 500; March Madness and the Arena Football League

Major League Baseball Advanced Media (MLBAM) and the MLB Players Association (MLBPA) have sued CDM Fantasy Sports claiming that CDM has no right to use the names and statistics of MLB players in its fantasy leagues.  MLBAM asserts that the players own their names and stats and that CDM (and other fantasy league operators) have misappropriated this intellectual property without the players consent.   So far the lower courts have ruled in favor of CDM saying that the players’ names and statistics are in the public domain.  Please give us your gut opinion:
